The Wisconsin State Patrol arrested an Oshkosh man riding his motorcycle in Waupaca on Oct. 1 for his fourth suspected Operating While Intoxicated (OWI) offense.
A trooper stopped 44-year-old Benjamin Kuhn around 6:45 p.m. on County Highway K, south of State Highway 22, after observing him pass in a no-passing zone. Upon initiating contact, the trooper “observed multiple indicators of impairment,” and conducted standardized field sobriety tests, which confirmed Kuhn was impaired.
This is Kuhn’s fourth alleged OWI offense; court records show he was convicted of his last offense in July. A fourth OWI conviction is a Class H felony in Wisconsin, carrying a mandatory sentence of 60 days to six years in prison and up to $10,000 in fines.
In addition to the OWI, Kuhn is also being held on an order-to-detain from the Wisconsin Department of Corrections.
